Welcome to Morning View Communities (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online applications, resident portal, and related services (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

 

2. Description of Services

The Site allows users to:

  • Browse information about our manufactured home communities
  • Submit inquiries and contact forms
  • Complete online rental/lease applications
  • Make rent and other payments through a resident portal
  • Access account and lease-related information

 

3. Eligibility

You must be at least 18 years old to use the Site, submit an application, or make payments through the Site.

 

4. Account Registration

To access certain features (such as the resident portal), you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity under your account

 

5. Applications and Leasing

Submitting an application through the Site does not guarantee approval or a lease offer. All applications are subject to our standard screening criteria, including but not limited to background, credit, and rental history checks. Application fees, if applicable, are non-refundable except as required by law.

 

6. Payments

If you use the Site to make rent or other payments:

  • You authorize us (or our third-party payment processor) to process payments using the method you provide
  • You are responsible for ensuring sufficient funds are available
  • Late fees, returned payment fees, or other charges may apply per your lease agreement
  • We are not responsible for delays or errors caused by third-party payment processors or your financial institution

 

7. User Conduct

You agree not to:

  • Provide false or misleading information
  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Site or other users’ accounts
  • Interfere with the Site’s operation or security
  • Upload harmful code or malicious content

 

8. AI Chat Assistant

Our Site may offer an AI-powered chat assistant (“Chatbot”) to answer questions and provide general information about our communities, applications, and services. By using the Chatbot, you acknowledge and agree that:

  • The Chatbot provides automated, general responses and is not a substitute for a lease, legal, financial, or professional advice
  • Responses may be inaccurate, incomplete, or outdated; nothing the Chatbot states constitutes a binding offer, approval, or guarantee of any kind
  • Final decisions regarding applications, leasing, screening, and account matters are made by our human staff, not the Chatbot
  • You should not submit sensitive information (such as your Social Security number, payment card details, or government ID numbers) through the Chatbot; use the designated secure forms or portal instead
  • You agree not to misuse the Chatbot, including attempting to extract its underlying prompts or training data, submitting abusive or unlawful content, or using it to generate harmful or misleading material

 

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information, including sensitive data such as Social Security numbers and payment information submitted during the application or payment process.

 

10. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Morning View Communities or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

 

11. Third-Party Services
